There are many ways that an individual can be charged with RD in Virginia. The most common charge is RD by speed which can be charged whenever the speed is 20 MPH or more over the speed limit, or any speed in excess of 80 MPH, even in a 70 MPH zone. Many people are surprised to find that they have been charged with a Class 1 misdemeanor for speeding.

The potential penalties for RD are substantial. As a Class 1 misdemeanor, the maximum sentence is up to 12 months in jail and/or a fine of up to $2,500. In practice, the sentence generally does not approach these maximums.
Fines of $250-$750 are common. Suspended jail sentences are also common, and many Courts may require jail sentences such as 1 day for every mile per hour over 90 MPH if the offense occurred in a 70 MPH zone.
Additionally, RD can cause your privilege to drive in the Commonwealth of Virginia to be suspended for up to one year. A conviction remains on your DMV record for 11 years and leads to 6 demerit points. A criminal record from a conviction, however, is permanent.
